Federal court denies special prosecutor Jack Smith access to Scott Perry's phones

A federal appeals court has blocked the way in front of special prosecutor Jack Smith as his investigation into the January 6, 2021, riot continues.

The U.S. Court of Appeals for the District of Columbia Circuit ruled Wednesday that Smith could not gain access to the cell phone records of Rep. Scott Perry (R-Pa.) because doing so would violate the lawmaker's immunity under the Constitution. “speech and debate clause.”

Smith was seeking Perry's communications with colleagues and executive branch officials, POLITICO reported. But the clause in question protects lawmakers from being affected by legal proceedings while performing official duties.CBrief
