U.S. District Judge Stephanie Haines upholds Trump's Alien Enemies Act

 


For the first time, a federal judge has upheld President Donald Trump's use of the Alien Enemies Act (AEA), a power Trump invoked during wartime to deport Venezuelans he claims belong to a criminal gang.

U.S. District Judge Stephanie Haines, a Trump appointee in Pennsylvania, upheld Trump's March 14 proclamation declaring that the Tren de Aragua, a violent Venezuelan gang, is conducting an "incursion" into the United States. Trump has also designated that gang, as well as El Salvador's MS-13, as a terrorist organization.

Haines also ruled that the government has not provided sufficient notice to people facing deportation under the AEA. She ordered that the government must provide at least 21 days' notice, considerably longer than the 12 hours some deportees have received, NPR reported.
