Gun control provision likely unconstitutional, federal judge rules

 


A federal judge in Texas is the latest to hit the gavel against a Biden administration effort to enforce a gun control provision, ruling that it is likely unconstitutional.

Last week's ruling against the ban on gun racks came as a result of a lawsuit filed against the measure by the Wisconsin Institute for Law & Liberty (WILL) on behalf of members of the National Association for Gun Rights Inc. and Texas Gun Rights. Inc., Fox News reported.

The lawsuit argued that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), which requires some 40 million gun owners to register their names on a gun registry and pay a tax, violates the infringement clause of the Second Amendment of the Constitution.

Fox notes that if gun owners refuse to register and pay the tax, they could receive a 10-year prison sentence and fines of up to $10,000 under the rule. Additionally, the rule redefined pistols with arm-stabilizing supports that are often attached to pistols to make them more controllable and easier to shoot with one hand, particularly for disabled veterans, as “short-barreled rifles.”CBrief
